Historic England Open Data Hub Terms and Conditions

1. Subject to the Open Government Licence v3 (OGL), you are granted a worldwide, perpetual, non-exclusive licence to use the Historic England Data.

2. You must always use the following attribution statements to acknowledge the source of the information:

   © Historic England [year] and for spatial data only add Contains Ordnance Survey data © Crown copyright and database right [year].

3. The same requirement for an attribution statement must be contained in any sub-licences of the Historic England Data that you grant, together with a requirement that any further sub-licences do the same.

Historic England Open Data Hub disclaimer

1. Historic England Data is updated on a regular basis. It is current only to the date of the dataset as given on the Open Data Hub. When re-using Historic England Data we recommend that you make its currency clear through a statement such as ‘The Historic England Data contained in this material was obtained on [date]. The most publicly available up to date Historic England Data can be obtained from HistoricEngland.org.uk.’
2. Please note the use of Historic England Data does not suggest any official status or that Historic England has endorsed you or your use of the Historic England Data and you must not mislead others or misrepresent the Historic England Data or its source.
3. As well as the terms of the Open Government Licence (OGL) other laws exist which protect archaeological sites, historic buildings and landscapes which must be adhered to and Historic England Data must not be used to break these laws.
4. As well as laws protecting sites there is legislation that must be complied with when using data and it is your responsibility to ensure you comply with the Data Protection Act 2018, UK General Data Protection Regulation and the UK Privacy and Electronic Communications Regulations 2003 (and any successor legislation).
5. Historic England trademarks or logos are exempt from the OGL.
6. All intellectual proprietary rights in the Historic England Data and the documentation remain vested in Historic England and its licensors. Where Ordnance Survey base mapping has been used to create certain Historic England Data, Ordnance Survey may also claim Intellectual Property Rights in the data.
7. Spatial data is provided solely to indicate the location of the area.
8. All new Listed buildings and any substantive amendments since 4 April 2011 will contain a map showing a blue line around the principal listed building. In some instances where powers under s1 (5A) (a) of the Planning (Listed Buildings and Conservation Areas) 1990 Act have been invoked, the polygon will clearly define the extent of listing and exclude from protection anything outside of it. For all other instances, the polygon shows the principal listed building or buildings and does not define the curtilage.
9. Historic England Data is licensed 'as is' and Historic England excludes all representations, warranties, obligations and liabilities in relation to the Historic England Data to the maximum extent permitted by law.
10. Historic England will not be liable (whether directly or indirectly) for any loss or damages arising out of or in connection with any use of the Historic England Data, any infringement of third-party intellectual property rights or any decisions made on the basis of this data.
11. Historic England is not liable for any errors or omissions in the Historic England data and shall not be liable for any loss, injury or damage of any kind caused by its use.
